The University General Counsel is the legal officer of the University. The general counsel supports the dynamic educational environment of the University of La Verne by providing legal advice to foster sound decision-making in all areas of operation, instruction, research and administration. The general counsel provides overall strategic and ethical leadership and direction for all legal matters involving the University, including personnel and student issues; education law; regulatory matters, risk assessment, and compliance issues; contractual and construction matters; government relations; and financial and research concerns. The general counsel provides advice on sponsored and grant programs, including intellectual property. The general counsel selects, retains, and monitors the work of outside counsel on a case-by-case basis, as well as monitoring outside counsel costs. The General Counsel reports to the President of the University.
•Develops and implements an ethical vision and strategic plan for the University’s legal services.
•Supports the University’s functions and business through the delivery of legal support and guidance.
•Provides advice on legal matters, issues, and policies such as: tax, employment and labor law, education law, government relations, contractual and construction matters, contracts, transactions, civil rights, student affairs, claims, use of federal and state funding, insurance, Title IX and risk management that concerns the University to the Trustees, President, Cabinet Members and other senior leaders, human resources, administrators, faculty, and staff.
•Reviews and advises University policies, procedures, and handbooks including drafts of new policies, procedures, and handbooks and advises administrators and faculty on the same; ensures consistency among all policies, procedures, handbooks, etc.
•Provides counsel to administrators and faculty regarding proposed or existing University contracts; reviews all proposed University contracts.
•Collaborate with Office of Strategic Communication to ensure consistent messaging when representing the University to the public.
•Maintain University licensing, trademark, and copyright agreements.
•Identifies and manages legal risk consistent with University priorities defined by the Trustees, as delegated to the President in management of her team.
•Establishes a clearly understood framework for legal policies within the Office of the General Counsel.
•Recommends operational and policy changes necessitated by legislative mandates; develops alternative policies to enable the University to accomplish its objectives.
•Determines the need for and delivers legal services, including representation with respect to claims, litigations and proceedings, to the University and all its divisions, units, departments and any future owned or controlled affiliates (including arranging for and overseeing the delivery of such legal services by other attorneys employed by the University or by independent counsel engaged by the General Counsel for the benefit of the University).
•Manages the delivery and costs of needed legal services and the budgets and other resources of the University provided for legal services. Screens and selects outside counsel and refers matters to outside counsel when appropriate. Facilitates direct communications between administrators and outside counsel when it increases efficiency, while maintaining budget control and supervision.
•Counsels University constituents on minimizing legal risks and costs, reducing litigation exposure, and ensuring legal compliance; efficiently, expeditiously, reliably and professionally.
•Establishes, manages, and oversees the inaugural Office of General Counsel.
•Collaborates and helps coordinate with various campus departments to ensure the University operates within the appropriate legal governance framework; to provide training and training materials on legal issues to appropriate constituencies when education is helpful to maintain or further University objectives; to educate, advise, and counsel faculty, staff and students to reduce or transfer risks.
•Represents the University before state and federal agencies as appropriate. Works closely with outside attorneys on litigation involving the University in federal and state courts and in administrative agencies.
•J.D. from a nationally accredited law school.
•Current membership in good standing with the California State Bar or obtains such membership within 12 months of employment.
•Admitted to practice, or the ability to be sworn in, before all applicable Federal courts.
•Strong background in the legal representation of academic institutions.
•A minimum of 5 years in practice and 3 years of experience advising academic or education-related institutions, either in an in-house or outside counsel capacity.
•Significant knowledge of laws and regulations applicable to academic institutions, and significant familiarity in general with the operational and organizational environment of undergraduate and/or graduate private institutions.
•Demonstrated ability to manage multiple priorities and work under deadlines.
•Demonstrated ability to gain trust and inspire confidence at all levels of an academic institution.
•Excellent oral and written communication skills, including the ability to communicate complex issues and legal concepts to non-attorneys.
•Demonstrated ability to navigate effectively through and successfully work with different departments and constituencies within a University community.
•A deep appreciation for, and a commitment to, the benefits of diversity
•High level of analytical and problem solving skills, and the ability to solve problems proactively and pragmatically.
•Excellent presentation and project management skills.
•Excellent judgment and interpersonal skills, and negotiation and mediation skills and experience.
The successful candidate must possess the ability to competently interact with a culturally and ethnically diverse population of students, faculty, and staff; and must be able to successfully complete a background investigation upon offer of employment.
