Essential Job Functions:
1. Ensures all complaints are handled in compliance with applicable laws, regulations and college policies and procedures to include prompt and equitable responses to reports of sex discrimination, sexual harassment/assault/violence/misconduct.
2. Conducts prompt/thorough investigations, acts as a neutral party in the investigation and prepares formal, written findings on conclusions of investigations/recommendations for remedial action, when appropriate.
3. Analyzes each complaint then develops an investigation plan. Contacts all involved parties & provides them with information about the investigatory process. Interviews the complainant, respondent, & potential witnesses. Provides resource referrals to students, faculty and staff who could benefit from additional support during the investigation. Gathers and secures evidentiary materials. Keeps accurate and thorough records and notes of investigatory process. Analyzes information gleaned from investigation to determine findings. Develops comprehensive reports used to determine policy violations. Advocates for improvements in the investigatory process.
4. Works collaboratively with OD/HR, Student Affairs, and Safety/Security and Risk Management Departments to ensure complaints are reviewed in accordance with Title IX and other appropriate standards including managing interim measures and assurances of safety for the impacted student, employee, and/or visitor. Provides on-going updates to the appropriate College Offices as necessary.
5. Reviews, researches and analyzes federal/state laws, regulations, and case law development in the areas of employment law, civil rights, discrimination/harassment/retaliation, and equal opportunity/affirmative action. Stays abreast of current and emerging regulatory obligations and develop plans of action for remaining in compliance with federal Title IX, equal opportunity/civil rights compliance laws & regulations.
6. Reviews and ensures College policies, regulations, and standard operating practices are in compliance with Title IX, equal opportunity, discrimination, harassment, and retaliation policies and federal/state laws.
7. Identifies areas of institutional risk and exposure related to Title IX and other compliance requirements. Makes recommendations to Senior Administrators to address identified areas of risk and changes that may impact the College.
8. Creates/implements Title IX and other relevant compliance plans in collaboration with key stakeholders on and off campus. Monitors the campus climate through surveys, focus groups, and other assessment efforts to identify opportunities for improvement in the College’s Title IX programs/services.
9. Prepares annual reports on sexual misconduct complaints, identifies trends/patterns, and makes recommendations as appropriate.
10. Spearheads the development and implementation of specialized education/training on Title IX, equal employment opportunity, and civil rights laws. Leads/designs educational awareness programs to address and prevent the effects of sexual misconduct, including prevention and bystander programs for faculty, staff, and students. Delivers training sessions about sexual violence and coordinates educational offerings about other gender-equity topics. Regularly presents educational training to HR professionals and others on civil rights issues and equal opportunity issues.
11. Responds to questions and inquiries from members of the College community regarding Title IX/discrimination/harassment/retaliation policies and complaint procedures.
12. Assists the VP, OD/HR on the research and management of the College’s equity program, including annual reports and compliance with such audits regulated by federal and state statutes via the Florida Department of education.
13. Maintains effective collaborative working relationship with campus presidents/deans/HR professionals, and others; serves on various committees as appropriate.
1. Juris Doctorate degree, or other relevant advanced degree, with a minimum of 5 years’ experience in employment law in a higher education, corporate or government human resources setting with responsibility for Title IX compliance, equal opportunity and civil rights complaint resolution, investigations, alternative dispute resolution, law enforcement or related experience.
2. Demonstrated knowledge of and ability to interpret federal and state equal opportunity and non-discrimination laws and regulations, including Title IX, Title VII, sexual harassment, and other applicable laws and regulations. Awareness of current trends in Title IX programs, discrimination and harassment policies and procedures, and higher education.
3. Experience with the complexities surrounding discrimination, harassment, sexual assault/ harassment, and retaliation cases, preferably in a college setting.
4. Understanding of investigation practices and experience conducting investigations in a sensitive and confidential manner. Experience with alternative dispute resolution processes a plus.
5. A demonstrated commitment to the professional development of faculty and staff and knowledge of due process rights and responsibilities.
6. Excellent organizational, research, investigatory, and analytical skills; advanced verbal and written communication skills, superb listening skills and ability to effectively provide education to faculty and staff.
7. A sense of urgency and responsiveness when dealing with complaints and investigations, and an ability to handle multiple tasks in a timely manner.
